RESOLUTION NO. 2025-03

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TECUMSEH,
OKLAHOMA, ADOPTING A FEE SCHEDULE REGARDING OPEN RECORDS
ACT REQUESTS.

Be It Resolved by the City Council of the City of Tecumseh, Oklahoma, a municipal corporation, that:

WHEREAS, the City of Tecumseh, in accordance with the Oklahoma Open Records Act (OKLA. STAT. TIT. 51 § 24A.1 et seq.) may charge a fee for recovery of its reasonable direct costs of record copying or mechanical reproduction of records subject to inspection and copying under the Act, and;

NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF TECUMSEH, OKLAHOMA:

THAT, the Fee Schedule for Costs of Reproduction shall be $0.25 per page for photocopies of records up to 8 1/2" x 14" or smaller; copies of other media (e.g. CD-ROM, flash drive, etc.) shall be the actual cost of reproduction, including the cost of the media and labor.

BE IT FURTHER RESOLVED, if such request is solely for a commercial purpose or would clearly cause excessive disruption of the City's essential functions, City may charge an additional fee to recover its direct cost of records search and copying, and,

BE IT FURTHER RESOLVED, the Fee Schedule for Requests Subject to Additional Recovery Costs shall be TWENTY-FIVE DOLLAR ($25.00) per hour fee for commercial requests or those that cause excessive disruption of office functions; and

BE IT FURTHER RESOLVED, in accordance with OKLA. STAT. TIT. 51 § 24A.1 et seq., at the discretion of the City Clerk may require a deposit for any fee whenever the estimated amount exceed $10.00; and

BE IT FURTHER RESOLVED, there shall be a TWENTY-FIVE (25.00) for any video put on a USB drive; and,

BE IT FURTHER RESOLVED, there shall be an ONE HUNDRED DOLLAR ($100.00) per hour fee when additional legal support is required; and

BE IT FURTHER RESOLVED, City reserves the right to recover the actual cost of record search and copying, including labor, if the information requested is not readily available or requires an extended amount of time to retrieve; and,

BE IT FURTHER RESOLVED, all fees for copies, including delivery fees, must be paid by check or money order, payable to City, before the documents are provided or if a deposit is required prior to the start of any work; and
